Terms of Service

General Provisions

These Terms of Service set out the rules and conditions for using the KilnStatistics — Virtual Studio online platform, available at kilnstatistics.com, and the associated KilnStatistics mobile application available on the Google Play Store.

The Service Provider is Koncept-IT Piotr Wawrzyniak, based in Poland, operating at: 46-320 Praszka, ul. Mickiewicza 3, Poland (hereinafter: "Provider", "we", "us").

Using the Service constitutes full acceptance of these Terms of Service. If you do not agree with its content, please stop using our services.

Definitions

• Service — the KilnStatistics platform available at kilnstatistics.com, including the mobile application
• Provider — Koncept-IT, owner and operator of the Service
• User — an individual or legal entity that has registered an account in the Service
• Account — an individual User profile in the Service, created after registration
• Trial Plan — a free 60-day trial period with access to full Service functionality
• PRO Plan — a paid subscription plan providing full, unlimited access to the Service
• User Data — all information, content and data entered by the User into the Service
• Activation Code — a unique code issued by the Provider enabling activation of the PRO Plan
• Mobile Application — the KilnStatistics application available for Android devices on the Google Play Store

Registration and User Account

3.1. Registration Requirements

Registration in the Service is voluntary and free of charge. To create an account, the User must:

• have a valid email address,
• provide their name,
• set a password meeting security requirements (minimum 8 characters),
• accept these Terms of Service and the Privacy Policy,
• be of legal age or have consent from a legal guardian.

3.2. Email Verification

After registration, the User will receive a verification link to the provided email address. Account activation occurs by clicking the link. The verification link is valid for 24 hours.

3.3. Account Security

The User is obliged to keep their login credentials confidential. If unauthorized access to the account is suspected, the User should immediately change their password and notify the Provider.

3.4. Data Accuracy

The User is responsible for the accuracy and currency of data provided during registration. Providing false data may result in suspension or deletion of the account.

Plans and Fees

4.1. Trial Plan

Every new account automatically receives a 60-day free trial period (Trial Plan) with access to full Service functionality. After the trial period expires, access to the Service is limited until the PRO Plan is activated.

4.2. PRO Plan

The PRO Plan provides unlimited access to all Service features. Activation is done by entering an activation code in Profile → License and subscription. Activation codes are issued by the Provider based on individual arrangements.

4.3. Pricing

The current PRO Plan pricing is available at kilnstatistics.com. The Provider reserves the right to change pricing with 30 days' notice to active Users.

4.4. Payments

PRO Plan payments are processed through trusted payment operators. Invoices are issued based on data provided in the User's profile.

4.5. Refunds

Due to the nature of digital services, refunds for activated PRO Plans are not standard. In justified cases, the User may submit a refund request by email to office@kilnstatistics.com within 14 days of payment.

Scope of Services

5.1. Service Features

The KilnStatistics Service offers the following features:

• management of ceramic firing history,
• management of ceramic kiln data,
• organization and management of ceramic workshops,
• notes and documentation of own works,
• sales and cost records,
• contact and invoice management,
• generating reports and statistics,
• synchronization of data with the mobile application,
• generating PDF reports.

5.2. Service Availability

The Provider strives to ensure Service availability 24 hours a day, 7 days a week, but does not guarantee uninterrupted operation. Planned maintenance will be communicated in advance.

5.3. Changes to Functionality

The Provider reserves the right to modify, add and remove Service features. Users will be notified of significant changes in advance.

User Rights and Obligations

6.1. User Rights

The User has the right to:

• use all Service features in accordance with the purchased plan,
• access, modify and delete their data,
• export their data in available formats,
• receive technical support,
• cancel the use of the Service at any time.

6.2. User Obligations

The User is obliged to:

• comply with these Terms of Service,
• use the Service in accordance with its purpose,
• enter only true and up-to-date data,
• not share their account with third parties,
• protect their login credentials.

6.3. Prohibited Activities

The User is prohibited from:

• creating multiple accounts to circumvent Trial Plan limitations,
• attempting to hack or gain unauthorized access to the Service,
• copying, decompiling or reverse engineering the software,
• sharing content that infringes third-party rights,
• using the Service for purposes contrary to law,
• taking actions that may disrupt Service operation.

Provider Rights and Obligations

7.1. Provider Rights

The Provider has the right to:

• suspend or delete the account of a User who violates the Terms,
• modify Service functionality,
• change pricing with required advance notice,
• contact the User regarding Service-related matters.

7.2. Provider Obligations

The Provider undertakes to:

• ensure the security and confidentiality of User data,
• inform about significant changes to the Terms or functionality,
• provide technical support,
• regularly create data backups.

Intellectual Property

8.1. Rights to the Service

All intellectual property rights to the Service, including rights to software, user interface, graphics, logos, names and content prepared by the Provider, belong exclusively to the Provider and are legally protected.

8.2. Rights to User Data

Data entered by the User into the Service remains the exclusive property of the User. The Provider makes no claim to content created by Users.

8.3. License to Use the Service

The Provider grants the User a non-exclusive, non-transferable license to use the Service solely for their own purposes, in accordance with these Terms.

Data Protection

The Provider processes Users' personal data in accordance with the Privacy Policy available at kilnstatistics.com/privacy_en.html and in accordance with applicable law, including Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

Detailed information on the processing of personal data, User rights and security measures is contained in the Privacy Policy.

Liability

10.1. Limitation of Provider Liability

The Provider is not liable for:

• Service interruptions caused by force majeure or infrastructure failures,
• data loss resulting from User actions,
• indirect damages or lost profits of the User,
• actions of third parties that compromise account security,
• the accuracy of data entered by the User.

10.2. User Liability

The User bears full responsibility for content entered into the Service and for using the Service in a manner inconsistent with these Terms.

Termination

11.1. Cancellation by the User

The User may delete their account at any time by contacting the Provider at office@kilnstatistics.com. Account deletion is irreversible and results in permanent deletion of all User data.

11.2. Account Suspension by the Provider

The Provider may suspend or delete a User's account in the event of:

• violation of these Terms,
• suspected unauthorized access or fraudulent activity,
• non-payment for the PRO Plan after the trial period,
• a court or administrative order.

11.3. Discontinuation of Service

In the event of Service discontinuation, the Provider will notify Users with at least 30 days' notice and enable data export.

Complaints

12.1. Filing a Complaint

Complaints regarding Service operation may be submitted electronically to: office@kilnstatistics.com

A complaint should include:

• User identification data (name, email address),
• description of the problem or objection,
• date of the issue,
• expected resolution.

12.2. Processing Complaints

The Provider processes complaints within 14 business days of receipt. The User will be informed of the outcome electronically.

Final Provisions

13.1. Changes to Terms

The Provider reserves the right to amend these Terms. Users will be notified electronically with at least 14 days' notice. Continued use of the Service after this period implies acceptance of the new Terms.

13.2. Governing Law

These Terms are governed by Polish law. Matters not regulated by the Terms are subject to the Polish Civil Code and other applicable legislation.

13.3. Dispute Resolution

The parties agree to resolve disputes arising from use of the Service amicably. If no agreement is reached, disputes will be resolved by the competent Polish court.

13.4. Consumers

Users who are consumers have the right to out-of-court dispute resolution through the ODR (Online Dispute Resolution) platform available at: ec.europa.eu/consumers/odr

13.5. Effective Date

These Terms come into force on April 1, 2026.
